Le Congrès adoptera la loi 21 sur le tabac cette semaine

La législation fédérale sur le tabac 21 sera incluse dans le projet de loi de dépenses qui doit être adopté par le Congrès avant les vacances de Noël afin d’éviter une fermeture du gouvernement. La nouvelle loi inclura les cigarettes électroniques parmi les « produits du tabac » limités aux 21 ans et plus.
La disposition bénéficie d’un large soutien bipartite, notamment du chef de la majorité au Sénat, Mitch McConnell, qui a présenté sa propre législation sur le tabac 21 plus tôt cette année. Le projet de loi est également soutenu par le puissant démocrate de l’Illinois Dick Durbin, un farouche opposant au vapotage.
Le président Trump a indiqué lors de la récente table ronde sur le vapotage à la Maison Blanche qu’il soutiendrait probablement un projet de loi T-21. Le projet de loi doit être adopté par les deux chambres du Congrès et signé par le président pour devenir loi.
Le langage dans le projet de loi de dépenses provient d’autres projets de loi bipartites T-21 de Sens Durbin et Mitt Romney, et Sens. Todd Young et Brian Schatz, selon ABC News. La facture est décrit comme “propre” par Paul Blair d’Americans for Tax Reform, ce qui signifie qu’il n’inclut aucune disposition sans rapport qui le rendra controversé.
Le libellé du projet de loi sur les dépenses n’inclut pas d’interdiction des saveurs ni de restrictions sur les ventes en ligne, selon Blair, qui a été l’un des principaux défenseurs du vapotage à Washington et une figure clé dans la lutte contre l’interdiction des saveurs annoncée par l’administration Trump en septembre.
Actuellement, l’âge légal pour acheter des produits de vapotage varie selon les États. Cette année, les lois T-21 ont été très populaires et ont été adoptées par les législatures des États. Dix-neuf États et le District de Columbia limitent désormais les ventes de tabac aux 21 ans et plus, ou ont adopté des lois T-21 qui entreront en vigueur plus tard. Trois autres États ont fixé à 19 ans l’âge légal. L’âge minimum pour acheter du tabac dans les 28 autres États est de 18 ans. Le projet de loi du Congrès oblige les États à modifier leur âge minimum ou à perdre l’aide fédérale.
Les partisans de Tobacco 21 affirment que les élèves du secondaire auront moins accès aux produits pour adultes si leurs pairs ne sont pas en mesure de les acheter. De nombreux lycéens ont 18 ans, mais peu d’élèves du secondaire ont des amis âgés de 21 ans. Les amis et la famille sont la source la plus courante de produits de vapotage utilisés par les lycéens.
“Pour moi, la menace la plus sérieuse implique l’utilisation de dispositifs de vapotage pour les adolescents de moins de 18 ans”, a déclaré le sénateur McConnell en avril. Bien trop souvent, des jeunes de 18 ans qui sont encore au lycée et peuvent acheter légalement des appareils de vapotage les partagent avec leurs plus jeunes camarades de classe », a déclaré le sénateur McConnell.
